Bankruptcy and Restructuring Services

NAV has performed the full range of debtor and creditor services across Chapter 7 liquidations and Chapter 11 reorganizations. More importantly, our leadership team has served as interim financial executives with operating records of restructuring distressed entities.

We understand that bankruptcy assignments blend the full-range of forensic, transactional, and valuation capabilities in a single and multi-faceted environment due to the nature of complex, distressed entities. We have served as interim CFOs and Chief Revenue Officers responsible for driving revenue, propelling organizational change, establishing internal controls, and preparing monthly operating reports. Operating “knee-deep” in a tumultuous environment, the financial advisor also must be able to raise employee morale and communicate tough decisions in conjunction with management, creditors, and other key parties to the legal proceeding. We pride ourselves in functioning across different capacities and not just as an outsourced finance department or a third-party financial advisor.

How We Assist Clients

Our range of bankruptcy services includes timely and robust valuation services such as 1) solvency opinions, 2) valuations of debt, equity, and overall business enterprises, 3) intangible assets, and 4) fixed assets such as inventory and machinery.

In addition, we provide other key bankruptcy and restructuring advisory services such as:

Advising management on strategies for liquidity and asset disposal

Business plan design, execution, monitoring and stress-testing

Cost savings initiatives and cost planning

Debtor-In-Possession (DIP) negotiations

Enacting organizational changes to human resource policies

Forensic investigations for fraudulent conveyances or improper cash disbursements before and during the bankruptcy

Financial reporting preparation such as mandatory monthly operating reports ("MORs")

Identifying possible strategic partners and investment sources

Implementing strategic recommendations for improving internal controls and IT design

Interim CFO and Controller services such as cash disbursement analysis, bank negotiations, treasury functions, and key monthly report metrics for management and creditors

Negotiating concessions from either debtors or creditors

Preparing detailed internal operating budgets, cash flow projections, and asset run-off models for both legal filings and creditor requirements

Special situation M&A and capital infusion negotiations

How We Are Transparent

A successful turnaround doesn’t happen overnight. Emotions are always high. Stress and dynamic change are to be expected and tackled immediately. The financial advisory team must radiate high-energy and be relentless in communicating tough decisions without any delay or sugar-coating.

Our team at NAV is also highly flexible. For example, in our core industry sectors such as real estate management, we have worked as the lead bankruptcy advisor or have been contracted as an additional sub-advisor for a turnarounds seeking additional assistance.

We strive to deliver firm-wide improvements and financial advisory blending diverse expertise and proven operational records. Please reach out for more information on our full-range of bankruptcy advisory services.
